how do i make a ds/dsi game to submit to nintendo like somelia did?

Couldn't they get the SDK and develop games on their own then get it licensed.
E.G. Be indie/take out the company step?

Unfortunately, I think the only really good way of doing that is to actually work for Nintendo with a reputation of making good games.
You could try writing a game proposal to them, which usually involves a long, formal letter or email explaining your idea. However, there's no guarantee they'll accept it. I'm not even sure if Nintendo looks at game proposals for existing series, so don't set your hopes too high.
