Hmm... Scratch have lawyers that run through MIT. I've sent them an email so that we can all learn the truth, the whole truth and nothing but the truth! Hopefully they will post here, otherwise if they reply to me I will relay what they said here
I believe that it goes like this though my opinion is as informed as everyone else's here .... If the person who uploaded the song had the rights to upload it you may download it, if not you may not. Once you have downloaded it you may copy it and listen to it yourself but you may not redistribute it or let others listen to it in a place you do not own or to more than a certain number of people unless you too have the redistribution rights. This is why software like CD rippers, youtube converters etc are legal, you are allowed to copy music for your own personal use.
But, lets see what the Scratch team say!

I'm pretty sure grabbing copyrighted songs from projects is illegal, but Scratch degrades the sound quality so much that the record companies probably wouldn't care.
Either way, the people putting copyrighted songs in their projects are technically more at fault.

What about Fair Use? It makes it so it is legal to use copyrighted material for educational use. (like on Scratch) It is legal to do that.

You have to remember that some songs on scratch may be protected by copyright for example if the scratcher used copyrighted music then you shouldn't use it.

Oh boy, here we go again. Ish clarification tiem.
Creative Commons doesn't mean the owner revokes his/her copyright to a project, it just means that the person is allowing other to use the elements in the project for certain uses (ie, the elements are still copyright to the original owner, he/she is just allowing other people to use it whereas normally, under most copyright laws, this would not be allowed). If a Scratcher makes a piece of music and puts it in a project, anybody can use the music (via the CC license), but they cannot copyright it (the creator of the music still owns the copyright).
Creative Commons DOES NOT cover cases where you take a copyrighted work (aka, you didn't create it) and put it in a project. Fair Use allows for copyrighted work to be put in a project.
Now what if we download the music from the project and put it on our iPod/mp3 player/music device? If it's covered by Creative Commons, you can probably download it onto your iPod/mp3 player/etc. without fear of doing anything illegal. If it's covered by Fair Use, then no, that probably would be illegal.

If the song is used in a project because it has a Creative Commons License, it's legal. If it used because of Fair Use, then illegal.

ok, i think i get it now: if its covered by CC, wich means your aloud to use it, then its legal, but if its covered by FU, and the song in the project was used becasue the creator asked permission, then its illegal. right i think ive get it :J
