Updated. Oh, and I didn't bold illusionist's name during the update because he's a retired mod (I think we need to distinguish who's a current admin or mod who signed the list, usually active admins hold much more weight in these things than those who are retired), so I underlined him instead.

Listen, if the petition worked, the project would be up. MIT supports intellectual property, and they have lawyers they could call. Why is it down if Namco is wrong?

Re: Project Pac-Man: Petition

I don't even see Namco's argument for being able to ask it to be taken down- the Creative Commons Act completely covers this to prevent this kind of argument.

Actually, in this case, the process for pursuing a case of copyright infringement here is two-fold. Normally, in a case of copyright infringement, the project owner would be contacted directly. The case would then go to court, as it normally would. However, since the project is posted through another medium (the Scratch website), the first step is that Namco-Bandai had to send a notice for Scratch to take the project down before proceeding with a case any further. The use of lawyers here only goes for the case if Scratch refuses to take the project down, it has nothing to do with the copyright infringement issue here.

The second step is that Namco-Bandai would then continue to pursue the case and sue the project owner. That step deals directly with the copyright infringement issue. However, Namco-Bandai has not done so.

Since it seems that Namco-Bandai has not pursued the case any further, we can conclude that Namco-Bandai either doesn't care about the case anymore or doesn't feel that the case could be won in court. Thus the project could be re-uploaded to the website; it's just up to the project owner to decide on whether or not he wants to do so. [In similarity, this is why a lot of so-called "abridged series" shows get taken down a lot on YouTube but then reappear later on. Bots usually flag content they feel to be copyright infringement, but reappear later on when this is proven not to be the case. The process repeats itself when bots flag the same stuff over and over again when, in reality, there is no such claim of copyright infringement at all].

The original point of the petition was to get the project back up and gain an apology; but since it's up to the project owner to post it up, I think the petition is more or less here because we disagree with Namco-Bandai trying to force Scratch's hand and remove the project for a case they did not agree with. What we really want is some kind of apology by Namco-Bandai for making a ridiculous, baseless claim.

Some of us have sent e-mails and letters, and wrote articles about this. From most of the comments I've seen on the articles, it seems a lot of other people outside Scratch agree on the side of the project owner and disagree with Namco-Bandai (save for one commenter).

It would be nice if we can get the e-mail address (or at least a regular posting address) of some of the higher office-ranks (like a CEO) so we can all send messages to them about this.

CEO's usually have personalized company-related e-mail addresses somewhere on the main site, that's the one we need to find if we want to send an e-mail.

ok, then, someone should scour the namco site. I'll look some if I can have a link to the site.
