It is totally legal because of "the “Fair Use” doctrine incorporated into the Copyright Act of 1976, 17 U.S.C. § 107", and "All projects shared on the Scratch website, as well as the Scratch support materials, are shared under the Creative Commons license with the conditions: Attribution - Share Alike." Which states: "You are free:

    * to Share — to copy, distribute and transmit the work
    * to Remix — to adapt the work
    * to make commercial use of the work" 
That would be sharing it.

However,
"Other Rights — In no way are any of the following rights affected by the license:

    * Your fair dealing or fair use rights, or other applicable copyright exceptions and limitations;" 
means that if it is protected by a copyright, then the copyright holder legally can sue you.  So, my answer to you, is, sure, you can use it for private use, but don't advertise that you got it for free or that you have not bought it.

TL;DR:
sure, you can use it, as long as you don't use it for commercial use.

This is my random copyright interperatation of the scratch cpyright policy in regard to using music in scratch programs for private use.

Actually you cannot use any project on the site for commercial gain (or loss for that matter) however you can share it using the same creative commons licence.  smile

I said for private use.

@veggie  The all-scratch was for reference if anyone wanted to see it for the future.  The reply to the advaced forums topic was a reply to something ion the wrong from, and this is showing people my fail copyright interpertation.

Some people don't want to be a criminal.

You know that old commercial on DVDs abotu how "you wouldn't steal a car, so why pirate?" They're right. Pirating is just like stealing a physical object in terms of crime.
