Copyright

What would happen if I posted a project that was copyrighted by someone who isn't me?

Would it get flagged?

Would I get sued by the copyrighters?

Would scratch get sued?

Would it be ok?

Please answer this. I NEED TO KNOW!

Yes. It would be okay. Scratch will not get sued... -.- But you should at least give credit to who originally made it! And you will not get flagged  tongue

A project of someone elses. Well the creator wouldn't be very happy :L

It depends. If it is an exact carbon copy with no credit given then probably.

Would I get sued by the copyrighters?
No.

Would scratch get sued?
No.

Would it be ok?
Well apart from one angry guy there should be nothing to worry about.

If you're talking about something from another site then that would be okay. Scratch wouln't get sued and you wouldn't get into trouble.

Why?  It allows us to use every form of media without care.  Else there'd be no Mario projects allowed and such.

Of course remixing can be annoying but sometimes it's an opportunity for another to learn from your work or improve it.

Well, despite this being a bit of a bumped oldie thread, I'm gonna come in an answer anyway.  tongue

Mind you, I'm answering these questions based on the premise that a copyrighted Scratch project (that is, one released elsewhere without some kind of permission license) was posted on the website, not the idea of a Scratch project based off a commercial game being posted.

The original creator could flag it since it's a copyrighted work that doesn't belong to you. It's also possible for the original creator to follow through what is given in here regarding copyright violations. Whether it gets taken down will depend if the Scratch administrators determine if it a clear case of copyright infringement.

Would I get sued by the copyrighters?

You might; it depends on if the copyright holder wants to press charges. When you release a Scratch project on the website, two things are implied: (1) that you are the creator of the project and you own the original copyright to it and (2) you decide that, along with your copyright, you share this project under the given CC license. By uploading a copyrighted project that isn't yours you falsely claim that you created it and theoretically there's some kind of damage because other people had access to download and remix it.

Would scratch get sued?

Theoretically, they could get sued (but that would be more on the part if the Scratch administrators refuse to honor the copyright claim and take the project down).

Would it be ok?

Depends on how the situation turns out. Best-case scenario would be the project being taken down with the copyright holder not pressing anymore charges. Worst-case scenario is a lawsuit.

Absolutely not - there are hundreds of thousands of Mario games on this website right now. As long as you're not selling it for money, they really don't have any right to sue you.

Absolutely not - there are hundreds of thousands of Mario games on this website right now. As long as you're not selling it for money, they really don't have any right to sue you.

No. Because this is an educational website, it uses an educational license. If you used it for commercial purposes, you could get sued

Iam Sure it's Ok! Copyright, Unless You Have Paid for it and Claimed it First, Isn't Copyright! First, You have to be over Eighteen and Have Enough Money to CopyRight It.
People on Scratch 90% are Just Lying to Keep people of There work. I don't Think you can Legally Copyright Something you just Did on Scratch. "Copyright©"
