And to make sure the body is good and structural, I have built a good amount of this in real life to test things out. Like the arms. There's a peg to connect the arm with friction, and a peg without friction (so it would fall to a 180 degree angle rather than 90). So before it was the second, but I fixed it so it was the first, so that's good...
Something about that face looks a bit wonky to me. I think it's because the face looks too flat whereas the snout juts out from the Scratch Cat's head. Maye you should move the eyes one stud back into the head?

Hmm, good point. I didn't think about that.
Firstly, I replaced the nose with this piece:

(in black)
That should help it stick out. And I'll look into the eye issue.

The LEGO Scratch Cat the the MIT Media Lab has the whiskers sticking out near the nose, so maybe those thin, long black LEGO pieces sticking out from near the nose?
If it were me, I'd use black tring for whiskers, wedged between two blocks.

I don't think it'd be an offense. For instance, my friend likes the anime Sailor Moon. If I gave her fanart of it for her birthday, I doubt that'd be unlawful.

Well, I was thinking more along the lines of giving away free prints on a massive scale (like at an anime convention or something). But even then, I'm not sure.
But I don't think giving it away as a b-day present is problem.
