Know what copyrighted music is

I know many people are all like "ill get it from beemp3.com because its free!". Guess what? Thats illegal. Its copyrighted material meening you cant post it on anywhere unless you paid for it and beemp3.com clearly states that the music downloads are only for listening to and is PHROHIBITED that you use it other wise. THIS IS THE LAW! These rules apply for all free music download sites. The bands/recording companies will highly unlikely sue you but you never know. I know you say you're too young to be sued or put in jail, you can be sued and you can be sent to the juvinial detention hall. I have seen people all claiming that giving credit makes up for it. Well it doesnt. So stay legal please. The whole purpose of this is because i see so many people saying they used free music download sites.

Some is public domain, and anyway, Scratch projects are under "Fair Use" which means we can legally use it for educational purposes.

(The educational use in Scratch stems from it helping kids learn programming)

As soup said, scratch is under the fair use policy, I thought it said that somewhere in the agreement. Funny how many people do not read those things.

I am simply putting this up because peoplemay think they can use free music for everything. Which can be bad. So it's better to start with good habits because it takes a while to break bad habits

While the "Fair Use" clause does allow certain uses of copyrighted music, the copyright holder might still object to seeing it in a Scratch project.  It's safer to use music that you create yourself or that has rights that explicitly allow reuse, such as most of the music on Newgrounds.

Andres' has a lot more information on this same kind of issue in the discussion on the recent request to remove a Pacman project from Scratch.  Check this out.

Here's a tip for avoiding DMCA violations: Don't use copyrighted content.
No music, at least commercial stuff. No pictures/images.

Concepts can't be copyrighted. Use them to your hearts content.

Oh, and Mario fans, try using sprites from "Secret Maryo Chronicles". GPL, BTW.

This is half right , if you PAYED for the music you can not be sued right off the bat. You will get a warning first. And also , putting the name and who its by is legal as long as you are not making any money off of the game / program. But downloading any music that was not made by the download host or given promission to put it up free is illegal to download. Be careful!

Wrong, ryandoo. I'm afraid you CAN be sued for uploading content not owned by or licensed to you (ever wonder how itunes does it? licensing).

The correct interpretation is... if you bought, say a music CD, you can legally (or semi-legally) rip and back it up. Sharing online, however, breaks the rules.

Say I drew a picture of Sonic, animated it, and put it here. The image isn't copyright Sega/Nintendo because I drew it, it's more of a concept, but Sonic is still copyrighted. Just thought it should be put out there in case it's not obvious.

Ah, that would most likely count as fan art, which falls under the Fair Use doctrine.  smile

That is true so as long as the music was attained in a legal way in the first place. While it may be ok to use "copyrighted" music on scratch, if you attain the music illegally, that is something that can be punishable by the extent of law.
