I have to say, this one is a pretty sad case here, Namco asking a project to be taken down despite the project being used for educational and learning purposes.

Or you could try getting around the copyright law [that has lost its rationale. Boo!] by renaming it "Scratch-Man" and making the the chomping circular character orange with ears and changing all the ghosts into Gobos.

Maybe if we got permission from Namco...? I doubt they'd let us though.

This has got to be one of the more stranger cases of copyright law I've ever seen, though. The rationale of US copyright law is that it is supposed to help protect creations, but there is also a "Fair Use" clause, which [I thought!] is supposed to protect Scratch projects because Scratch projects are posted on the website with educational purposes in mind.

Not quite sure on what legal grounds Namco Bandai has on trying to get the project removed from the website, but it otherwise seems to be a blatant case of ignoring the Fair Use clause. 

If only someone could point that out to Namco.

What'll happen to other projects that are copied from real games? Hope it doesn't happen to them... it'd be a shame if Scratchers couldn't replicate arcade games and such. 

Well seeing how Namco has no right to do this under the license Scratch is under, this is illegal. Whoever made the project has the right to sue them in court.

Does Namco realize that a KID made it?? There's no way that they were going to get it completely right, like the sounds, the motion of Pacman, and the AI of the ghosts. Also, the Scratch project doesn't evade copyright because it is completely editable! It's not like you can take the Scratch code and re-create a real Pacman console. One last thing, if anything, this should make Namco happy, because it shows that some people still have enthusiasm in their long-lost game.

EDIT: You never see Nintendo getting mad about all the Mario projects!
