Scratch Music

Does anyone know if it is legal to download music from Scratch and put it on iTunes?  I was thinking about doing it, but wanted to make sure it was legal.

I don't think it would be illegal to put it in iTunes, but you can't put the sounds on more than three iPods or other devices after that.

Do you mean that you just take sons off scratch projects  and then put them on your iPod?

If yes then that is legal, i do it too sometimes XD

If someone holds the rights to the music then you can't lawfully download it without paying. This would include downloading from scratch projects.

Hmmm...but I thought that when you downloaded Scratch, technically they gave you the sounds to use. Then couldn't you legally download the songs onto an iPod or other device?

I'm not a lawyer but I believe this is correct. 

Everything shared on Scratch is put there under a Creative Commons license with Share Alike attributes, meaning others can use it in the same fashion.  So if you create sprites and scripts and put them on Scratch, other Scratch users have every right to take that material and reuse it in their projects.  But if you take material that has restrictive copy rights, such as most commercially available music, and put it on Scratch things get a bit muddier.  You can argue that you have the right to use the music in the project under the "Fair Use" doctrine...but I don't think that removes the rights of the original holder which would probably block somebody else from reusing the music in some other fashion - such as putting it in iTunes. 

To make a long story short...unless the music was originally released under an open license, it is probably not legal to put that music into iTunes unless you paid for it.  For more information, take a look at our Copyright Policy statement.
