Policy on Plagerism

I'll keep this short.

I am a user on a website called Pokemon Topaz, which is producing a fangame. We have had sprites stolen from us, and none of us tolerate theft one bit.

The project using our sprites is:[removed by moderator - please don't point fingers at people in the forums - contact the Scratch Team if you have an issue], and we would like it completely removed (and possibly a warning for any future users), since it is still receiving attention and detracting from our own project (we use RPG Maker)

In fact, I believe that it is far too easy to steal and plagerize using Scratch, and I believe that the ease of access enables users to take what is not theirs and be lazy about it. As you can see in the example above, the user is too lazy to replace the sprites themselves with something they ARE able to use. Is it really THAT hard? I think not.

Please, remove the project and do something about your theft policy, since this has gone on long enough (as a note, I was one of the users of Orange Islands.net who called out a [removed by moderator - please don't point fingers at people in the forums - contact the Scratch Team if you have an issue] for being a massive thief, and as I am a user of Pokemon Topaz, I will do the same here).

(also, I wasn't sure which forum to put this in; there seems to be no ability to report abuse here?)

It does say "Credit to pokemontopaz for the sprites." at the bottom of the project notes, so it is acceptable for them to use your sprites, as they gave you credit.

I'm sorry, but we never gave [removed] permission to use them. They are the property of Pokemon Topaz and Pokemon Topaz alone. There is a difference between asking permission and giving credit, believe it or not.

Doesn't matter if it's copyrighted or not, we don't want them used here. Is that so hard to understand? It really grates on everyone's nerves when stuff is used without permission.

It's like every time someone plagerizes here, whenever someone calls them out on it, people defend them with poor excuses. We've gone through this [removed - please use respectful language] before, and trust me, it's very tiring.

Because it's stealing? And like I said, there's a difference between asking for permission to use something and just assuming that an artist is OK with you using that same something if you "tell others that it's not yours".

I swear, I'm dealing with a whole den of thieves here...

It's not stealing. Scratch is free and opened source. If someone took my project and used all the sprites in other projects, would I care? No. I would be flattered at least that they thought my sprites were good enough for them.

Thievery:  Taking w/o giving credit

Didn't you see the credit?

Also, we use Creative Commons.  You CANNOT LEGALLY TAKE SOMETHING DOWN, EVEN IF IT HAS COPYRIGHTED THINGS (unless it's used for profit), UNLESS THEY DO NOT GIVE CREDIT.

There is a difference between giving credit and asking permission.  Scratch is a free educational site and we hope that copyright holders will be generous with their works - but if they really don't want to allow it to be used for educational purposes, there is a procedure.  Please contact us at the email above.

Just to clarify for everybody - when work that you own is posted to Scratch, it is done so with the understanding that it can now be reused by anybody, so long as credit is given.  That does not mean that you can share other people's work on the site and their rights disappear.  If they are the copyright owners and they follow the procedure in the DCMA link - we will consider their claim.
