Re: Monetizing games

I think I've seen a similar thread before... a long time ago.  I don't remember how it ended up, sorry  sad

You may want to ask the Scratch Team.  If I've seen this before, it's possible they have a agreed-upon response (or one may actually know the legalese off the top of their heads xD)

Re: Monetizing games

I'm pretty sure it is allowed, but you may want to wait for a scratch team member or moderator to provide more detailed information.

Re: Monetizing games

It is allowed if you upload it to your own website, but if you post it on Scratch you cannot require a fee to download it

Re: Monetizing games

Scratch projects uploaded to the Scratch website are automatically under the Creative Commons 2.0 Attribution-Share Alike license, meaning that anyone may redistribute your project under the following conditions:

-Give credit to the original author (Attribution)
-Share the project under the same license (Share Alike)

The Scratch 1.4 license states that you may distribute the program freely on your website, CDs or other media, as long as you state that Scratch is a program created by the Lifelong Kindergarten Group, at the MIT Media Lab, available for free at this website.

I'm no lawyer, but all I can assume from this, is that there's no true restriction against the commercial distribution of Scratch projects. I certainly wouldn't buy a Scratch project, and wouldn't attempt to sell one given that Scratch is an educational, interpreted language that requires the Scratch program itself, or the web players to be played.

If you can figure out how to make the end user run the project easily, and a way to sell it, I'd say go for it.

(in fact, the Creative Commons license linked to above, says explicitly that "You are free: (...) to make commercial use of the work". This doesn't necessarily refer to the author, though - I'd be careful.)

Ok, I'm going to assume a few things.
1.  It's not on the Scratch website
2.  You don't have any music you didn't buy on the program
3.  All the art is yours
4.  You contacted the company and they allowed you to have the commercial for cash
...I'm not sure.  Ask Lightnin, he'd know.

Re: Monetizing games

If you have the rights to all the assets (music, sprites) used in the project, then no problem: It's your intellectual property. Even if it's in the website; see my post.

1.  It's not on the Scratch website
2.  You don't have any music that either A). you have not been given a license to use for commercial purposes unless the music's original license allows for commercial use (examples of licenses that let you sell works with them are all CC licenses except for ones including NC (non-commercial) and public domain works)
3.  All the art is yours or distributed under a license that allows you to use it for commercial purposes
4.  You contacted the company and they allowed you to have the commercial for cash
...I'm not sure.  Ask Lightnin, he'd know.
5. any scripts that you may have borrowed from any other project must abide by the terms of the license of that project

Fixed

For 5, you can use scripts from any project with proper credit.
