"iOS jailbreaking is the process of removing the limitations imposed by Apple on devices running the iOS operating system through the use of hardware/software exploits — such devices include the iPhone, iPod touch, iPad, and second generation Apple TV. Jailbreaking allows iOS users to gain root access to the operating system, allowing them to download additional applications, extensions, and themes that are unavailable through the official Apple App Store. Jailbreaking is a form of privilege escalation, and the term has been applied to privilege escalation on other computer systems as well. Ummm, okay. They figure out how to get cool features and stuff unavailable otherwise. I want to jailbreak my iPod. LOLHOW?

Google is your friend. I believe the programs are like Redsn0w or GreenP0ison or something. I unfortunately can not jailbreak my iPad because I am under contract with my school. xD
Also, jailbroken devices can access the app store? I always thought you had to chose between jailed (App Store) or jailbroken (Cydia)

Nah, you can still access the App Store and all that with a jailbroken device.
Right now I believe the most popular jailbreak tool is Greenpois0n; just make sure your device/OS version is supported first.
And yes, it's legal.

Jailbreaking is completely legal.
It can be used to use iDevices for things that cannot normally be done, such as things that require root permissions, or tinkering with system files. This means that many amazing things can be done using jail breaking, including dual booting iOS and Android.
There is always a chance of bricking your device, so don't do it unless you are confident in your skills to carry out the jailbreak successfully. I guess it's like breaking out of a jail in Mexico. It's not illegal, but if you mess up, you might get something bad happen to you

I jailbroke my iPod with Redsn0w. It is really cool. I even used iFile to cheat on a couple of games I was stuck on. I got an epic theme called Black UPS HD. AndroidLockXT is cool too. You can also run web servers and stuff like that.

It's sort of a metaphorical term - "jailbreaking" your Apple device allows you to gain access to certain things that are generally restricted by Apple, such as downloading Flash.
You can find many different tutorials on how to jailbreak your iPod based on which OS you have on it simply by Google searching it.
