Do you know how close to the original version the project was?
Using music and re-creating someone else's game seem to me like they are pretty far apart. I can understand if the game was an exact copy, then its ok to remove it, but if its just music used in a project for added effect, it doesn't seem likely that it will be sought out and removed.

Long story short: Someone created a PacMan project and Namco Bandai sent a DCMA notice to the Scratch Team asking for it to be taken down. See here for more info.
That's usually one of the rare exceptions, though (and one that considered to be an extremely mean, if not stupid, move). Most of the time, if a company is uncomfortable with a Scratch project based off one of a commercial game, the company will e-mail the Scratch Team, and what usually happens is that the compromise is to link to the company's game site in the project notes.
*not to mention there's nothing stopping you from uploading the project again under the Fair Use clause once it's taken down for DCMA reasons
