Of course it's legal. However, part of the rules of modifications is that the ability to upload to the Scratch website must not be there.

You can upload to Mod Share, though.

mods are legal but uploading modded projects to scratch is impossible

Dawgles's projects were made in something else though and he uploaded them

It's not illegal, but it's against the source code license. Besides, Insanity doesn't have functionality to upload to this site.
If you want to upload the project anywhere, you can upload it to Mod Share.

You mean RHY.
Which projects of his were made in "something else"? And how do you know?

If you downloaded it, there would be no Scratch Logo or something, I heard from markyparky

Jacob is correct.
To quote the rule:
"Substantially modified versions of the Scratch source code, as defined in the Scratch Trademark Policy, may not be used to upload projects to the Scratch website."

Projects made in substantially modified versions of Scratch most likely wouldn't work online anyway.

If I'm not mistaken, Scratch can only open actual Scratch projects.

It uses the same project files &c, it's just a graphical modification

Tell me about it, have you seen the Mod Share player?
What do you mean by that? I've run projects in the Mod Share player, yes.

In BYOB, projects don't work at all.
In other mods, the projects don't work very well in the player, and are missing a lot of parts. That's why I added the <Using Insanity?> block in Insanity.

If there's a different/no logo, yeah, it's changed.
