Spider Man is an Avenger, In the current avengers Comics called Avengers, hes a full time avengers member.

The movie rights to Spiderman belong to Sony, not the character itself.

Marvel comics is not the same as Marvel Studios (the company that owns The Avengers). The film rights to Spider-Man is owned by Sony, so he cannot appear in a Marvel Studios film.
They've actually been seemingly willing to cooperate with the franchises.

I've seen all the Avengers movies and can tell you that although I haven't seen the Spiderman reboot, he is NOT going to be in the Avengers movie although he is an Avenger in the comics. Even Wolverine is an Avenger, not just X-Men. But The Avengers movie series distributed by Walt Disney pictures believe it or not, has no interactions what so ever with Spiderman, X-Men, Fantastic 4 etc.
For those who take interest in small things like this, Ironman and
Incredible Hulk were originally owned by Paramount pictures then Disney took over and are paid to put up the Paramount logo at the start of all their movies!
The name Marvel has nothing to do with the movie studios, only the comics that the characters come from.
And for those who actually play Scratch games, not just talk about random stuff on the forums, I'm am at the moment developing. My new AvengersTD game which will include: Iron Man, Hulk, Thor, Captain America, Hawkeye and Spiderman. Yes I know what you're thinking but Spiderman is still awesome and if he's in the comics, that's good enough for me.
Also check out my THOR BATTLE ZONE games and others including my TRON games and the amazing Cross the Road. Sounds strange? Won't love till you try it!

Why would they be paid for the Paramount logo? I don't actually know if that was there but it seems a bit weird. Disney did buy the rights to Iron Man, and I think the rights to Hulk expired

It would have been an agreement of when Disney took over. The Paramount logo is still in all The Avangers movies, although it is no longer owned by them.

I dunno. I just thought that Hawkeye could have used at least a little more screen time. And the action part at the end dragged the whole thing down for me. The action just didn't feel satisfying.
