I didn't think it was illegal. 
It should be, though. That's basically demonstarating that hitting people is okay.

In fact recently on Yahoo Answers I found somebody who had to secretly go to the grocery store by himself to get food, because his mother wouldn't go. His mother's boyfriend was very violent too.

Sorry to hear that you are having a hard time at home - it sounds really rough.
With the violence that you have described, it might be a good idea to discuss this with an organization that specializes with this sort of issue. Maybe you should check out www.childhelp.org - they have a hotline you can call to help you decide what steps you can take to help improve things.
Since this topic is kind of out of scope for the Scratch Forums, I'm going to close it- but I'd like to say thanks to everybody who posted on the topic that tried to help out. I'm really impressed with your caring attitude
