Actually, it's been a feature for years, like before scratch. They just only used it now.

I think they should leave the banner there even after the New Year, just change the text to a link to the forum rules or something.

Not a bad idea. Personally, I think we need something to make people more aware of the ToU, etc before they post on the forums.

But you do have a nice idea though - maybe it could link to the Terms of Use?
