It's been legalised now. If you want to use it, there's no negative sanctions (Apart from voiding your warranty, meaning Apple won't fix it).
You can even do it online. A lot of people have been going into Apple stores, connecting to the WiFi and jailbreaking the display iPhones in store.
I know. Hilarious, right?
Anyway, you can jailbreak using jailbreakme.com on your iDevice. Just sync with iTunes first, and don't update to 4.0.2, as it closes the exploit that it (jailbreakme.com specifically) uses.
I have a 2nd generation iPod Touch. I want to update to the newer version (already running out of space, and iOS 4 is slow on it) but I can't really justify upgrading only 6 months after getting my current one.
And keikij, I actually use my iPod Touch almost more than my laptop for general media consumption. I use it to check my Twitter and email (I haven't used my computer-based email in months) read my feeds, watch YouTube, and play games. It's probably my most used device.

wouldn't it be cool if you could plug your ipod touch into your computer and have it interact with scratch projects just like with those sensor boards and stuff?

No, 4.0.2 fixes the PDF code bug, which jailbreakme.com uses. I can still use computer jailbreaks. Duh.
ONLY the pdf bug.

i don't know if anyone saw this when i posted it the first time or if it's being ignored.... but wouldn't that be cool? i don't know if Apple would allow it seeing as how we don't even have a Scratch App to make and/or view projects.

It was legal before that, it's just now everyone knows that it's legal.
