It's legal, if you use it to test your own content. It's not legal if you use it to play games that are meant to be played on consoles, and you didn't make them.
Do you really think those folks who make Windows Mobile apps use real phones to test these apps? If so, where's the debugging, eh, Steve?

I don't exactly have the professional version yet, but from the name I take it that it is marketable. If you have a flash cart, you can put it on your DS (not DSi though), and the program doesn't work for macs.
