It's legal, if you use it to test your own content. It's not legal if you use it to play games that are meant to be played on consoles, and you didn't make them.
Do you really think those folks who make Windows Mobile apps use real phones to test these apps? If so, where's the debugging, eh, Steve?

You couldn't be more incorrect.
Emulation is the simulation of a console on another platform.

Actually Nintendo forbids any outside use of an emulator, cough cough. Read its legal page.

Only because it encourages piracy, not is piracy.

I don't exactly have the professional version yet, but from the name I take it that it is marketable. If you have a flash cart, you can put it on your DS (not DSi though), and the program doesn't work for macs.

Well, I emailed Nintendo. We'll hopefully find out soon enough.

Here's the message I received:
Hi [you'll never know my name], thank you for contacting us.
In order to forward your report to the appropriate personnel, we need additional information regarding the product being sold. At your earliest convenience, please respond to this email with this information (include your original email and this response).
For more information regarding piracy in the videogame industry, please visit the Entertainment Software Association's website (www.theesa.com).
Sincerely,
Barbara Soules
Nintendo of America Inc.
I don't know what to do, since frankly, I don't know anything about the product.
08jackt, can you help me?

Heh, coaconut, you got an automated response. It's like a 5 digit code they type in for that message, and the person who's dept. it's from's name gets signed at the end.
